CREDIBILIDAD Y REPERCUSIONES CIVILES DE LAS ACUSACIONES DE MALTRATO Y ABUSO SEXUAL INFANTIL

Resumen

En el presente trabajo se analiza el creciente y preocupante problema de las falsas alegaciones de abuso sexual infantil en el ámbito judicial, en las que generalmente los menores son inducidos por parte de uno de sus progenitores a proporcionar un falso testimonio. Discriminar e identificar, lo que sin duda constituye una grave forma de maltrato infantil, constituye un reto y una de las demandas periciales más frecuentes a los psicólogos forenses. Hemos intentado separar criterios diferenciadores entre casos reales y falsos e ilustrar a los profesionales que puedan trabajar en este ámbito, sobre posibles errores metodológicos que pueden contribuir a validar denuncias no fundamentadas en lo real y en muchos casos interpuestas por motivaciones o ganancias secundarias.

Abstract

This work analyzes the increasing and troublesome problem of false allegations of infantile sexual abuse in the judicial setting, where, as a rule, the minors are induced by one of their parents to provide false testimony. To discriminate and identify what is doubtless a severe form of child mistreatment is a challenge and one of the most frequent expert demands received by forensic psychologists. We have attempted to separate the differentiating criteria between real and false cases and to illustrate for professionals who may be working in this area the possible methodological errors that can contribute to validating accusations not based on real facts and, in many cases, made with a view to secondary motives or gains.
